Brief history of the issue

3. The brief history of the issue is as follows:

a) The Government of Andhra Pradesh have issued G.O.Ms.No.505,

Education Department, dated 16.11.1998 (AP Educational Service Rules)

and G.O.Ms.No.538, Edn., dated 20.11.1998 (AP Education Subordinate

Service Rules) by integrating the services of the teachers working in

Government and ZillaParishad. Aggrieved by this, Govt. Teachers have

approached the Hon'ble Tribunal in various OA's and the Hon'ble APAT in

their orders dated.04-05-2000 have issued orders validating the said

G.O's

b) The Government Teachers again filed W.Ps in the Hon'ble High Court

of AP, challenging the orders of the AP Administrative Tribunal. The

Hon'ble High Court in the W.P.No.11325/2000 dated 18.09.2003 ordered

as follows viz., G.O.Ms.No.538, Edn., Dept., Dt. 20.11.1998 was quashed

restoring the rules framed by the Government in G.O.Ms.No.278, Dt.

20.06.1983. As far as the G.O.Ms.No.505, Edn., dated 16.11.1998 is

concerned, it has declared as invalid to the extent of the posts covered by

G.O.Ms.No.529, Dt. 14.05.1976, on the ground that the rules are in

violation of Presidential Order.

c) Government of Andhra Pradesh have issued an Ordinance No.12/2005

and later enacted as Act 27/2005. As per the provisions of the Act

27/2005 Government have issued Service Rules

integrating the services in

G.O.Ms.No.95 Education, Dated 25.06.2005 governing the Service Rules

of the Gazetted Officers and G.O.Ms.No.96, Education, Dated 25.07.2005

governing the Service Rules of the teachers.

d) These Rules issued in G.O.Ms.No.95 & 96 were challenged in OA No.

3109/2005 and batch before the Andhra Pradesh Administrative Tribunal
