Sub: WDA, TG & SC - Providing admissions to Children with Special Needs
in the schools without any discrimination as per RPD Act, 2016-
Ref: Representation of CWSN parents Association, Yanamalakuduru Road,
Vijayawada, Dt. 19/08/2019.
***
I am to inform that in the reference cited, the Children with Special Needs
Parents Association, Yanamalakuduru Road, Vijayawada represented that some
of the Head Masters are not admitting the children .with Special Needs due to
their disability. The above Association has also stated that CWSN have rights to
get admissions and pursue their studies under Right to Education Act, 2009.
Hence, the parents and CWSN are suffering due to rejection of admissions by
the Head Masters.
In this connection, I am to inform that section 16 of the Rights of Persons
with Disabilities Act, 2016 says that all education institutions funded or
recognised by Govt., shall provide inclusive education to the children with
disabilities and towards that end shall -
(i) admit them without discrimination and provide education and
opportunities for sports and recreation activities equally with
others;
(ii) make building campus and various facilities accessible;
(iii) provide reasonable accommodation according to the individual's
requirements;
(iv) provide necessary support individualised or otherwise in
environments that maximise academic and social development
consistent with the goal of full inclusion;
(v) ensure that the education to persons who are blind or deaf or both
is imparted in the most appropriate languages and modes and
means of communications;
(vi) detect specific learning disabilities in children at the earliest and
take suitable pedagogical and other measures to overcome them;
